{"id":62244,"date":"2020-11-05T08:57:45","date_gmt":"2020-11-05T07:57:45","guid":{"rendered":"https:\/\/lcgb.lu\/?p=62244"},"modified":"2020-11-05T08:57:45","modified_gmt":"2020-11-05T07:57:45","slug":"luxair-accord-tripartite-les-delegues-du-lcgb-ont-valide-les-textes","status":"publish","type":"post","link":"https:\/\/lcgb.lu\/fr\/2020\/11\/05\/luxair-accord-tripartite-les-delegues-du-lcgb-ont-valide-les-textes\/","title":{"rendered":"Luxair Accord Tripartite : Les d\u00e9l\u00e9gu\u00e9s du LCGB ont valid\u00e9 les textes"},"content":{"rendered":"<p>Lors d\u2019une conf\u00e9rence des d\u00e9l\u00e9gu\u00e9s du LCGB en date du 4 novembre 2020, les diff\u00e9rents documents de l\u2019accord tripartite \u00e9labor\u00e9 entre la direction-g\u00e9n\u00e9rale de Luxair et les syndicats contractants ont \u00e9t\u00e9 valid\u00e9s.<\/p>\n<p>L\u2019accord pr\u00e9voit notamment un plan d\u2019avenir Luxair pour la p\u00e9riode 2020-2023, qui garantit l\u2019emploi et qu\u2019aucun licenciement pour raisons non-inh\u00e9rentes \u00e0 la personne ne sera effectu\u00e9 pendant la dur\u00e9e de l\u2019accord. Ceci se fait notamment par la cr\u00e9ation d\u2019une cellule de reclassement (CDR), un outil primordial et essentiel pour la gestion du sureffectif conjoncturel et structurel.<\/p>\n<p>La mission principale de la CDR sera de reclasser les salari\u00e9s, concern\u00e9s par des postes en sureffectif structurel, en interne \u00e0 la Luxair ou en externe aupr\u00e8s d\u2019autres entreprises ou de l\u2019\u00e9tat ou des communes, si n\u00e9cessaire par le biais d\u2019un plan de formation renforc\u00e9 et adapt\u00e9 aux besoins des salari\u00e9s et\/ou par le pr\u00eat temporaire de main-d\u2019\u0153uvre. La CDR sera support\u00e9e par les mesures du ch\u00f4mage partiel ainsi que les diff\u00e9rentes formes de pr\u00e9re\u00adtraite (pr\u00e9retraite pour travail post\u00e9, pr\u00e9retraite-ajustement, pr\u00e9retraite-ajustement progressive).<\/p>\n<p>Une garantie du salaire de base sera assur\u00e9e aux salari\u00e9s dans la CDR pendant les p\u00e9riodes d\u2019activit\u00e9 dans le cadre de missions temporaires en interne ou en externe ou dans le cadre du pr\u00eat temporaire de main-d\u2019\u0153uvre.<\/p>\n<p>Aux salari\u00e9s touchant l\u2019indemnit\u00e9 de ch\u00f4mage partiel, Luxair compensera la perte de salaire, par l\u2019attribution de 2 jours \u00e9quivalents par mois complet dans la CDR pendant les ann\u00e9es 2021 \u00e0 2023. Les jours cumul\u00e9s seront r\u00e9mun\u00e9\u00adr\u00e9s aux salari\u00e9s concern\u00e9s, lorsque Luxair aura atteint une rentabilit\u00e9 durable.<\/p>\n<p>La convention collective, quant \u00e0 elle, sera prolong\u00e9e de 3 ans jusqu\u2019au 31.12.2023 dans son int\u00e9gralit\u00e9 et avec tous les acquis, hormis les augmentations bar\u00e9miques (annuit\u00e9s ou biennales). En cas d\u2019un retour \u00e0 une meilleure fortune de l\u2019entreprise, les parties se sont accord\u00e9es que les annuit\u00e9s ou biennales suspendues seront \u00e0 n\u00e9gocier lors du renouvellement de la convention collective.<\/p>\n<p>Finalement, le LCGB constate avec satisfaction que l\u2019accord tripartite fait d\u00e9j\u00e0 ses premi\u00e8res preuves avant m\u00eame l\u2019instauration de la CDR, alors que Luxair et le Minist\u00e8re de la Sant\u00e9 viennent d\u2019introduire une demande de pr\u00eat temporaire de main-d\u2019oeuvre concernant une cinquantaine de salari\u00e9s afin de renforcer l\u2019\u00e9quipe du Contact Tra\u00adcing pendant plusieurs mois.<\/p>\n<p>&nbsp;<\/p>\n<p><em>Tripartite agreement<\/em><\/p>\n<p><em>LCGB delegates validated the texts<\/em><\/p>\n<p><em>At a conference of LCGB delegates on November 4th, 2020, the various documents of the tripartite agreement drawn up between the Luxair management and the contracting unions were validated.<\/em><\/p>\n<p><em>The agreement provides a future plan for Luxair for the period 2020-2023 along with an employment guarantee and prohibits any dismissals for reasons not directly related to the employee\u2019s person. The agreement further creates a reclassification unit (CDR), an essential tool for the management of cyclical and structural overstaffing.<\/em><\/p>\n<p><em>The main mission of the CDR will be to reclassify the structural overstaffers either internally at Luxair or externally to other companies, the government or the municipalities, if necessary, through a reinforced training plan adapted to the needs of the employees and\/or through a temporary loan of labour. The CDR will be supported by partial unemployment measures as well as the different forms of early retirement.<\/em><\/p>\n<p><em>Employees maintained in the CDR, receive their basic salary during all periods of activity, such as deployment on temporary internal or external assignments or a temporary loan of labour.<\/em><\/p>\n<p><em>For employees that receive receiving partial unemployment benefits, Luxair will compensate the loss on the basic salary by allocating 2 equivalent days per full month in the CDR between 2021 and 2023. The accumulated com\u00adpensating days will be paid once Luxair has achieved sustainable profitability.<\/em><\/p>\n<p><em>The collective agreement will further be extended for 3 years until December 31st, 2023 in its entirety and with all benefits, except for the scale increases (annual or biennial).
